Nike Terms of Sale

Nike updated its Terms of Sale document date and made two substantive but consumer-favorable changes: it softened the delivery-inspection instructions from a demand into a recommendation and added a clause confirming your statutory return/warranty rights are not limited by that section, and it narrowed the 'Events Outside Our Control' (force majeure) definition so Nike has less room to excuse delays or non-performance. Nothing in this update takes away consumer rights or protections.

367367When we receive your return, we will inspect the items to confirm they meet the return conditions in our Terms of Sale and returns policy which can be found at the footer of our website. If you exercise your right of withdrawal, we will process your refund within the applicable time limits. You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning. If the return is made outside the applicable return period, or if the goods are excluded from the withdrawal right under the law (e.g. made-to-measure or clearly personalized items), Nike reserves the right to refuse the return and to send the goods back to you at your expense.

371An "**Event Outside Our Control**" means any act or event beyond our reasonable control, including without limitation, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or failure of public or private telecommunications networks, or acts, regulations or restrictions by any public authority.

Nike narrowed the situations it can point to as being outside its control. Strikes now only count if they are 'unannounced', and any such event must actually make it genuinely impossible (not just Nike's fault) for Nike to fulfill its obligations. This makes it somewhat harder for Nike to use this clause to excuse delays, cancellations, or other failures to deliver.
