How reviews are made

This is the first full capture of Intel's Intel.com Website Terms of Use — the earlier snapshot was empty, and the document itself still carries the same "Last Modified: June 21, 2024" date, so Intel does not appear to have amended anything. Everything below is a baseline record of what these terms already say, not a new change by Intel. The most consumer-significant terms: anything you post to an Intel site gives Intel a permanent, irrevocable, transferable license that Intel and even other site users can use commercially forever; Intel can change the terms or shut down your account at any time with no notice; Intel disclaims nearly all liability and makes you cover its legal costs if you break the rules; and you must sue within one year, in Delaware courts. On the positive side, there is no forced arbitration and no class-action waiver.

CONTENT LICENSE

Post a comment, photo, or piece of code on an Intel site and you hand Intel a free license that lasts forever, can never be cancelled, can be sold or passed down through unlimited layers of other companies, and can be used commercially anywhere in the world. The license also runs to "any users of the Websites," so other people on the site get those rights as well. Intel says it does not own your content, but this license means you effectively lose control of it, and you get paid nothing.

“you grant Intel, its sublicensees, and any users of the Websites or the Materials, a nonexclusive, royalty-free, perpetual, unlimited, irrevocable, nonterminable, freely transferrable, and freely sublicensable (through multiple tiers of sublicensees) license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display the User Content”

What you can do — Don't post anything on Intel's sites — artwork, code, photos, product ideas — that you might later want to control, license, or be paid for. Intel also asks that you not send unsolicited ideas at all.

UNILATERAL CHANGES

Intel can rewrite these terms whenever it wants without emailing you or posting an alert. The new version applies the moment it goes up, and if you keep using the site you are treated as having accepted it. Your only way out is to stop using Intel's sites. Intel can also change or shut down site features and listed prices without notice.

“Intel may, but is not required to, substitute, add to, change, or remove any part of the Terms at any time without notice to you ("Modified Terms"). Modified Terms will be effective when posted by Intel”

What you can do — Check the "Last Modified" date at the top of the terms page before relying on anything important, since you won't be notified of changes.

TERMINATION

Intel can disable or suspend any account whenever it likes, for any reason or no reason, without telling you first. There is no appeal process described and no promise of getting back access or anything stored in the account.

What you can do — Keep your own copies of anything you upload or store in an Intel account — downloads, license keys, support history — so you aren't locked out of it.

LIABILITY LIMITS

Intel disclaims all warranties and says it isn't liable for any damages at all — including lost data or damage to your computer — from using the site or anything downloaded from it. On top of that, if you break the terms or post something that triggers a claim, you have to pay Intel's losses, fines, and lawyers' fees, and you can't settle that claim without Intel's written permission.

“You agree to indemnify, at Intel's election defend, and hold Intel and each of its officers, directors, employees, agents, representatives, partners, suppliers, and licensors (the "Indemnified Parties") harmless from and against all actions, claims, or demands, and all losses, damages, liabilities, fees, fines, penalties, costs, and expenses (including without limitation attorneys' fees and legal costs)”

What you can do — Back up your system before installing drivers or software downloaded from Intel's site, since Intel accepts no responsibility for lost data.

OTHER

If you use Intel's website or materials, you automatically grant Intel a free license to any patent claims of yours that touch on what's disclosed there, and you agree never to sue Intel for infringing them. You also may not use the site or its materials to research whether Intel is infringing someone's patent. This is unusual and mainly hits inventors, engineers, and small companies.

“You may not use or facilitate the use of the Websites or any Materials in connection with any patent or other intellectual property infringement analysis concerning Intel products.”

What you can do — If you hold or are seeking patents in areas Intel works in, get legal advice before browsing Intel's technical documentation.

LIABILITY LIMITS

Any legal claim about your use of Intel's sites must be filed within one year of when it comes up. Many states normally give you longer, so this shortens the window to sue.

“ANY CAUSE OF ACTION YOU MAY HAVE WITH RESPECT TO YOUR USE OF THE WEBSITES OR THE MATERIALS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ARISES.”

What you can do — If something goes wrong, talk to a lawyer well inside one year — waiting longer may cost you the right to sue entirely.

Disputes must go to Delaware courts under Delaware lawMATERIAL
JURISDICTION

No matter where you live, any dispute about the site is decided under Delaware law and must be filed in Delaware courts. Traveling to another state to sue over a small claim usually isn't worth it, which in practice discourages people from suing at all. The upside: there is no forced arbitration clause and no class-action waiver, so you keep the right to go to court and to join group lawsuits.

LIABILITY LIMITS

If someone else logs into your account, Intel says it owes you nothing for your losses — but reserves the right to charge you for losses Intel or a third party suffers, even if you had no idea it was happening.

“Intel will not be liable to you or to any third party for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.”

What you can do — Use a unique password and turn on any available two-factor login, and report unauthorized account use to Intel immediately.

Broad restrictions, including a ban on competing uses and any data miningMATERIAL
USER OBLIGATIONS

The rules go well beyond "don't be abusive." You may not run bots or scrapers, text or data mine, bulk-download the site, or use Intel's site or materials to build products or services that compete with or interfere with Intel's. Downloadable Intel documents are limited to personal, non-commercial use, and you can't publish benchmark or comparison results for Intel software. Intel decides when to enforce, and going easy once doesn't stop it enforcing later.

OTHER

Intel warns that what you send through its sites can be read or intercepted by others in transit, and says it may or may not review posted content. Intel accepts no liability for third-party content on the site, so you evaluate its accuracy at your own risk.

“Because internet transmissions are never completely private or secure, you acknowledge and agree that any User Content submitted or transmitted to or through the Websites may be accessed or intercepted by third parties.”

What you can do — Don't put sensitive personal or confidential work information into Intel forums, chats, or submission forms.

  5. + ADDEDYou may be held responsible if someone else uses your account

    If someone else gets into your account, Intel is not responsible for your losses — and Intel can still come after you for losses it or a third party suffers, even if you did not know about the misuse.

    However, Intel reserves the right to hold you liable for losses incurred by Intel or by a third party due to someone else using your account or password.

  6. + ADDEDPermanent, unlimited license over anything you post

    Anything you post, upload, or send through Intel's sites — comments, code, photos, forum posts — can be used, copied, changed, translated, published, and resold by Intel, its sublicensees, and any other site user, worldwide, forever, for free, and you cannot take it back.

  8. + ADDEDUsing the site grants Intel a license to your patents

    By using the site or its materials, you automatically give Intel a free license to any of your patents that cover subject matter disclosed there, and you promise never to sue Intel over those patents.

    you agree to grant to Intel (and do hereby grant to Intel) a non-exclusive, royalty-free license to any patent claims which include subject matter disclosed in the Websites or the Materials, and agree not to assert against Intel any claims for patent infringement based on any such patent claims.

    Rules include no scraping or automated bots, no text or data mining, no bulk downloading, and no using Intel's site or materials to build anything that competes with Intel. Intel decides when to enforce these, and not enforcing once does not waive the right later.

  11. + ADDEDOne-year deadline to bring any claim

    Any legal claim about your use of the site must be started within one year of when it arises, which is shorter than many state deadlines.

    ANY CAUSE OF ACTION YOU MAY HAVE WITH RESPECT TO YOUR USE OF THE WEBSITES OR THE MATERIALS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ARISES.

    If you violate the terms or post something that causes a claim, you must cover Intel's losses, fines, and attorneys' fees. Intel can take over the defense, and you cannot settle without Intel's permission.

    Intel can take down anything you post at any time, for any reason, without telling you, and can terminate or suspend accounts of people who repeatedly infringe copyright.

    Intel further reserves the right to remove User Content no matter the reason, in its sole discretion, and without prior notice to you or to any third party.

Any modifications to these Terms will not retroactively alter any contractual agreements unless explicitly agreed upon in writing to the contrary. The Terms otherwise apply to any resources and tools provided through the Websites, including but not limited to developer tools, software, download areas, research areas, community forums, chat rooms, blogs, sharing sites, and product information. Finally, the Terms apply to documents made available on the Websites such as white papers, press releases, datasheets, and specification documents but do not extend to any separate agreements you may enter through the Website's electronic signature tool. Hereafter, the foregoing documents will be referred to as the "Materials."

13**2.2 Supplementary Terms for Materials and Sub-Sites**: Certain Materials or sub-sites accessible via the Websites may have their own supplementary terms and conditions specific to them. By accessing or using those Materials or sub-sites, you accept and agree to be bound by the applicable supplementary terms and conditions. These Terms will apply and remain in effect with respect to those Materials and sub-sites, provided that, to the extent these Terms conflict with or are superseded by any such supplementary terms and conditions, the supplementary terms and conditions will govern and control.

15**2.3 Changes and Updates to Terms**: Intel may, but is not required to, substitute, add to, change, or remove any part of the Terms at any time without notice to you ("Modified Terms"). Modified Terms will be effective when posted by Intel, and your use of the Websites or the Materials after the posting of the Modified Terms will be deemed your acceptance of and agreement to be bound by the Modified Terms. The date on which the Modified Terms are posted will be stated at the beginning of the Modified Terms. If you do not agree to the Modified Terms, you must stop using the Websites and Materials. By accessing and using the Websites, you acknowledge that you have read and understand Intel's Privacy Notice. For the avoidance of doubt, information submitted through the use of an electronic signature tool will not opt you into the receipt of marketing communications.

25**3.2 Member Account, Password, and Security**: Accessing certain Materials and/or sub-sites may require that you establish a member account and select a password. It is a condition of your use of those Materials and sub-sites that all the information you provide as part of registering for an account is accurate, current, and complete. Your account is personal to you. You are entirely responsible for maintaining the confidentiality of your password and account. You may not permit any third party to use your account, nor may you use anyone else's account at any time. Furthermore, you are entirely responsible for activities that occur under your account. 554.1.11 Intentionally or unintentionally violate any applicable local, state, national, or international law, including but not limited to regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including without limitation the New York Stock Exchange, the American Stock Exchange, or the NASDAQ, and any regulations having the force of law;

574.1.12 Provide material support or resources (or conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization designated by the United States government as a foreign terrorist organization;

614.1.14 Perform automated searches against Intel's systems (except for non-burdensome federated search services), including using automated "bots," link checkers, or other scripts or web scraping technologies, without the prior written permission of Intel;

In addition, this section does not create any private right of action on the part of any third party or any reasonable expectation that the Websites or Materials will not contain any content or conduct that is prohibited by this section.

73**5.1 Retained Rights**: You acknowledge and agree that Intel or its licensors own all legal rights, title, and interest in and to the Websites and the Materials, and that the Websites and Materials are protected by worldwide copyright laws and treaty provisions. Except as set forth in these Terms and unless otherwise specified in the Materials themselves or pursuant to any license terms or permissions for the Materials, (a) no license rights or other rights are granted to you under any patents, copyrights, trademarks, or trade secret information, whether by implication, estoppel or otherwise, and (b) you may not modify, copy, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell the Websites or the Materials. Any unauthorized use of the Websites or the Materials may infringe Intel's or a third party's copyright rights, trademark rights, or other proprietary rights, may violate laws relating to privacy and publicity, and may result in civil or criminal liability.
