Google Terms of Service

This update replaces the U.S. version of Google's Terms of Service with the Germany/EU version, which is required to reflect EU consumer law. The contracting entity changes from Google LLC (USA) to Google Ireland Limited, and EEA users gain several new protections: a formal 'legal guarantee' against defective digital content/services, a 14-day right to cancel the agreement, home-country courts and law instead of California courts, a much narrower license over the content you create, and removal of Google's flat liability cap in favor of stronger EU liability rules. The one drawback: Google states it will not take part in free, out-of-court consumer arbitration/mediation boards, meaning unresolved disputes would need to go through the regular courts.

Google won't join free consumer arbitration/mediation boardsIf you have a dispute, Google says it won't voluntarily take part in an out-of-court…

If you have a dispute, Google says it won't voluntarily take part in an out-of-court consumer arbitration or mediation board (a common free/faster alternative to going to court in Germany). This means if you want a resolution, you'd likely need to go through the regular court system instead of a lighter-weight consumer board.

“Google is not willing or required to participate in dispute resolution proceedings before a consumer arbitration board.”

What you can do — If you have an unresolved complaint, contact Google directly first; if that fails, be prepared to pursue the matter in your local court rather than a consumer arbitration board.

99### We know it's tempting to skip these Terms of Service, but it's important to establish what you can expect from us as you use Google [services](https://policies.google.com/terms), and what we expect from you.
1010
11These Terms of Service reflect [the way Google's business works](https://about.google/intl/en_US/how-our-business-works), the laws that apply to our company, and [certain things we've always believed to be true](https://www.google.com/about/philosophy.html). As a result, these Terms of Service help define Google's relationship with you as you interact with our services. For example, these terms include the following topic headings:

1414- [What we expect from you](https://policies.google.com/terms), which establishes certain rules for using our services
1515- [Content in Google services](https://policies.google.com/terms), which describes the intellectual property rights to the content you find in our services - whether that content belongs to you, Google, or others
1616- [In case of problems or disagreements](https://policies.google.com/terms), which describes other legal rights you have, and what to expect in case someone violates these terms
1717
18Understanding these terms is important because, by accessing or using our services (whether you're signed in to a Google account or not), you're agreeing to these terms.
18Understanding these terms is important because, to use our services, you must accept these terms. We encourage you to download these terms for future reference. We make these terms, and all previous versions, available at all times [here](https://policies.google.com/terms/archive).
± CHANGEDYou must actively accept the terms, not just 'use' the service

Previously, simply using Google's services counted as agreeing to the terms. Now you must affirmatively accept the terms to use the services.

3738If you're under the [age required to manage your own Google Account](https://support.google.com/accounts/answer/1350409), you must have your parent or legal guardian's permission to use a Google Account. Please have your parent or legal guardian read these terms with you.

4344## Your relationship with Google
4445
45These terms help define the relationship between you and Google. When we speak of "Google," "we," "us," and "our," we mean Google LLC and its [affiliates](https://policies.google.com/terms). Broadly speaking, we give you permission to access and use our [services](https://policies.google.com/terms) if you agree to follow these terms, which reflect [how Google's business works and how we earn money](https://about.google/intl/en_US/how-our-business-works).

4748## What you can expect from us
4849
4950### Provide a broad range of useful services
5051
5152We provide a broad range of services that are subject to these terms, including:
5859Many of these services also include content that you can stream or interact with.
5960
6061Our services are designed to work together, making it easier for you to move from one activity to the next. For example, if your Calendar event includes an address, you can click on that address and Maps can show you how to get there.
6162
6263### Develop, improve, and update Google services
6364
64We're constantly developing new technologies and features to improve our services. For example, we use artificial intelligence and machine learning to provide you with simultaneous translations, and to better detect and block spam and malware. As part of this continual improvement, we sometimes add or remove features and functionalities, increase or decrease limits to our services, and start offering new services or stop offering old ones. When a service requires or includes downloadable or preloaded software, that software sometimes updates automatically on your device once a new version or feature is available. Some services let you adjust your automatic update settings.
65While we use a broad definition of "services" throughout these terms as described above, applicable law draws distinctions between "digital content", "services", and "goods" in certain situations. That's why we use the more specific terms in this section and the [Legal guarantee](https://policies.google.com/terms) section.
6566
66If we make material changes that negatively impact your use of our services or if we stop offering a service, we'll provide you with reasonable advance notice, except in urgent situations such as preventing abuse, responding to legal requirements, or addressing security and operability issues. We'll also provide you with an opportunity to export [your content](https://policies.google.com/terms) from your Google Account using [Google Takeout,](https://takeout.google.com/settings/takeout) subject to applicable law and policies.
67We're constantly developing new technologies and features to improve our services. For example, we use artificial intelligence and machine learning to provide you with simultaneous translations, and to better detect and block spam and malware.
6768
69As part of the continual evolution of our digital content, services, and goods, we make modifications such as adding or removing features and functionalities, increasing or decreasing usage limits, and offering new digital content or services or discontinuing old ones. We may also change our digital content or services for these other reasons:
70
71- to adapt to new technologies
72- to reflect increases or decreases in the number of people who use a particular service
73- to respond to key changes in the licenses and partnerships we have with others
74- to prevent abuse or harm
75- to address legal, regulatory, safety, or security issues
76
77We must also make legally-required updates, which are modifications that keep digital content, services, or goods in conformity with the law, for at least the minimum time period mentioned in the [Legal guarantee](https://policies.google.com/terms) section. We make these updates to our digital content, services, and goods for safety or security reasons, and to make sure they meet the quality standards that you expect, such as those described in the [Legal guarantee](https://policies.google.com/terms) section. We may automatically install updates that address significant safety or security risks. For other updates, you can choose whether you want them installed.
78
79We maintain a rigorous product research program, so before we change or stop offering a service, we carefully consider the reasonableness of the change or deprecation, your interests as a user, your reasonable expectations, and the potential impact on you and others. We only change or stop offering services for valid reasons.
80
81If a modification negatively affects your ability to access or use our digital content or services, or if we stop offering a service altogether, we'll provide you with reasonable advance notice by email - including a description of the changes, when they'll take place, and your right to end your contract with us if our modifications create more than a minor negative impact - except in urgent situations such as preventing abuse or harm, responding to legal requirements, or addressing security and operability issues. We'll also provide you with an opportunity to export [your content](https://policies.google.com/terms) from your Google Account using [Google Takeout](https://takeout.google.com/settings/takeout), subject to applicable law and policies.
± CHANGEDMore detail on notice for negative changes, plus a right to end your contract

If a change to a service hurts your ability to use it, Google now promises to notify you by email with details and, if the impact is more than minor, tell you that you can end your contract.

82
6883## What we expect from you
6984
7085### Follow these terms and service-specific additional terms
7186
7287The permission we give you to access and use our [services](https://policies.google.com/terms) continues as long as you comply with:
7388
7489- **these terms**
7590- **[service-specific additional terms](https://policies.google.com/terms/service-specific)**, which could, for example, include things like additional age requirements
7691
77You also agree that our [Privacy Policy](https://policies.google.com/privacy) applies to your use of our services. We provide resources like the [Copyright Help Center](https://support.google.com/legal/topic/4558877), [Safety Center](https://safety.google/), [Transparency Center](https://transparency.google/), and descriptions of our technologies from our [policies site](https://policies.google.com/technologies) to answer common questions and to set expectations about using our services. Finally, we may provide specific instructions and warnings within our services - such as dialog boxes that alert you to important information.
92You can view, copy, and store these terms in [PDF format](https://www.gstatic.com/policies/terms/pdf/20260730/4te5pybt/google_terms_of_service_en_de.pdf). You can accept these terms and any [service-specific additional terms](https://policies.google.com/terms/service-specific) when you're signed in to your Google Account.
7893
94We also make various policies, help centers, and other resources available to you to answer common questions and to set expectations about using our services. These resources include our [Privacy Policy](https://policies.google.com/privacy), [Copyright Help Center](https://support.google.com/legal/topic/4558877), [Safety Center](https://safety.google/), [Transparency Center](https://transparency.google/), and other pages accessible from our [policies site](https://policies.google.com/). Finally, we may provide specific instructions and warnings within our services - such as dialog boxes that alert you to important information.
95
7996Although we give you permission to use our services, we retain any [intellectual property rights](https://policies.google.com/terms) we have in the services.
8097
8198### Respect others
8299
83100We want to maintain a respectful environment for everyone, which means you must follow these basic rules of conduct:
84101
125142### What's covered

133150 - publicly-available factual information that you provide, such as corrections to the address of a local business. That information doesn't require a license because it's considered common knowledge that everyone's free to use.
134151 - feedback that you offer, such as suggestions to improve our services. Feedback is covered in the _[Service-related communications](https://policies.google.com/terms)_ section below.

150- modify and create derivative works based on your content, such as reformatting or translating it
165- use your content for technical purposes only - for example, to save your content on our systems and make it accessible from anywhere you go, or to reformat your content for compatibility with our services
± CHANGEDLicense over your content is significantly narrowed

Google's license to use content you create is now limited to technical purposes (like storing and displaying it) and no longer explicitly covers using your public content to promote Google's services or to develop new, unrelated products.

166- make your content publicly available if and only to the extent you've made it visible to others
151167- sublicense these rights to:
152168 - other users to allow the services to work as designed, such as enabling you to share photos with people you choose
153169 - our contractors who've signed agreements with us that are consistent with these terms, only for the limited purposes described in the _[Purpose](https://policies.google.com/terms)_ section below

159- **operating and improving the services**, which means allowing the services to work as designed and creating new features and functionalities. This includes using automated systems and algorithms to analyze your content:
160 - for spam, malware, and illegal content
161 - to recognize patterns in data, such as determining when to suggest a new album in Google Photos to keep related photos together
162 - to customize our services for you, such as providing recommendations and personalized search results, content, and ads (which you can change or turn off in [Ads Settings](https://adssettings.google.com/))This analysis occurs as the content is sent, received, and when it is stored.
163- **using content you've shared publicly to promote the services**. For example, to promote a Google app, we might quote a review you wrote. Or to promote Google Play, we might show a screenshot of the app you offer in the Play Store.
164- **developing new technologies and services** for Google consistent with these terms
175- for spam, malware, and illegal content
176- to recognize patterns in data, such as determining when to suggest a new album in Google Photos to keep related photos together
177- to customize our services for you, such as providing recommendations and personalized search results, content, and ads (which you can change or turn off in [Ads Settings](https://adssettings.google.com/))

166181### Duration
167182
168This license lasts for as long as your content is protected by intellectual property rights.
183This license lasts for as long as your content is protected by intellectual property rights, unless you remove your content from our services earlier.
169184
170185If you remove from our services any content that's covered by this license, then our systems will stop making that content publicly available in a reasonable amount of time. There are two exceptions:
171186
172187- If you already shared your content with others before removing it. For example, if you shared a photo with a friend who then made a copy of it, or shared it again, then that photo may continue to appear in your friend's Google Account even after you remove it from your Google Account.
173188- If you make your content available through other companies' services, it's possible that search engines, including Google Search, will continue to find and display your content as part of their search results.
174189
184199
185200Many [organizations](https://policies.google.com/terms), such as businesses, non-profits, and schools, take advantage of our [services](https://policies.google.com/terms). To use our services on behalf of an organization:
186201
187202- an authorized representative of that organization must agree to these terms
188203- your organization's administrator may assign a Google Account to you. That administrator might require you to follow additional rules and may be able to access or disable your Google Account.
189204
205If you're based in the European Union, then these terms don't affect the rights you may have as a [business user](https://policies.google.com/terms) of online intermediation services - including online platforms such as Google Play - under the [EU Platform-to-Business Regulation](https://policies.google.com/terms).
+ ADDEDNew EU Platform-to-Business Regulation reference for business users

The terms now clarify that EU-based business users keep their rights under the EU Platform-to-Business Regulation when using services like Google Play.

206
190207## Service-related communications

192To provide you with our services, we sometimes send you service announcements and other information. To learn more about how we communicate with you, see Google's [Privacy Policy](https://policies.google.com/privacy).

193210

195212
196213## Cellular, Wi-Fi, and other Network Connection Costs
197214
198215Google services may frequently use the Internet when you're not actively engaged with the services or your device. Google uses the Internet in this way for a wide variety of purposes - for example, to provide software updates and to improve Google's services, security, user experience, and/or Google's operations, including advertising. These uses rely on your cellular, Wi-Fi, and/or other network connections and may count against your data allowance with your cellular or internet service providers. You're responsible for all of these network usages and associated costs. You may wish to check your cellular or internet service plan, and your device and network settings.
199216
200217## Content in Google services
201218
202219## Your content
203220
204Some of our [services](https://policies.google.com/terms) allow you to generate original content. Google won't claim ownership over that content. Some content may not be suitable for everyone.
221Some of our [services](https://policies.google.com/terms) allow you to generate original content. Google won't claim ownership over that content.
205222
206223Some of our [services](https://policies.google.com/terms) give you the opportunity to make your content publicly available - for example, you might post a product or restaurant review that you wrote, or you might upload a blog post that you created.
207224
208225- See the _[Permission to use your content](https://policies.google.com/terms)_ section for more about your rights in [your content](https://policies.google.com/terms), and how your content is used in our services
209226- See the _[Removing your content](https://policies.google.com/terms)_ section to learn why and how we might remove user-generated content from our services
210227
233250Some of our services include software that's offered under open source license terms that we make available to you. Sometimes there are provisions in the open source license that explicitly override parts of these terms, so please be sure to read those licenses.
234251
235252You may not copy, modify, distribute, sell, or lease any part of our services or software.
236253
237254## In case of problems or disagreements
238255
239## Warranty disclaimer
256Both the law and these terms give you the right to (1) a certain quality of service, and (2) ways to fix problems if things go wrong. If you're a [consumer](https://policies.google.com/terms), then you enjoy all legal rights granted to consumers under applicable law, as well as any additional rights provided under these terms or [service-specific additional terms](https://policies.google.com/terms/service-specific).
240257
241We built our reputation on providing useful, reliable services like Google Search and Maps, and we're continuously improving our services to meet your needs. However, for legal purposes, we offer our [services](https://policies.google.com/terms) without [warranties](https://policies.google.com/terms) unless explicitly stated in our [service-specific additional terms](https://policies.google.com/terms/service-specific). The law requires that we explain this using specific legal language and that we use capital letters to help make sure you see it, as follows:
258## Legal guarantee
242259
243TO THE EXTENT ALLOWED BY APPLICABLE LAW, WE PROVIDE OUR SERVICES "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FOR EXAMPLE, WE DON'T MAKE ANY WARRANTIES ABOUT THE CONTENT OR FEATURES OF THE SERVICES, INCLUDING THEIR ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS.
260If you're an EEA-based [consumer](https://policies.google.com/terms), and you've agreed to our Terms of Service, then EEA consumer laws provide you with a [legal guarantee](https://policies.google.com/terms) covering the digital content, services, or goods that we provide you. Under this guarantee, we're liable for any [lack of conformity](https://policies.google.com/terms) that you discover:
± CHANGEDNew 'Legal guarantee' replaces the old warranty disclaimer

Instead of disclaiming almost all warranties, Google now describes a legal guarantee under EEA consumer law that makes it responsible for defective digital content, services, or goods for at least two years (or the life of a continuous service).

244261
245UNLESS EXPLICITLY PERMITTED BY [SERVICE-SPECIFIC ADDITIONAL TERMS](https://policies.google.com/terms/service-specific), DON'T RELY ON THE SERVICES FOR MEDICAL, LEGAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE. ANY CONTENT REGARDING THOSE TOPICS IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY, DOES NOT CONSTITUTE MEDICAL DIAGNOSIS OR TREATMENT, AND IS NOT A SUBSTITUTE FOR ADVICE FROM A QUALIFIED PROFESSIONAL.
262- within two years of the delivery of goods (such as a phone) or the one-time supply of digital content or services (such as purchasing a movie)
263- at any time during the "continuous" supply of digital content or services (such as Maps or Gmail)
246264
265Your national laws may provide an even longer guarantee. Your rights under these legal guarantees aren't limited by any other [commercial guarantees](https://policies.google.com/terms) that we provide. If you want to make a guarantee claim, please [contact us](https://about.google/contact-google/).
266
247267## Liabilities
248268
249269### For all users
250270
251Both the law and these terms try to strike a balance as to what you or Google can claim from the other in case of problems. That's why the law requires everyone to be responsible for certain [liabilities](https://policies.google.com/terms) - but not others - under these terms.
271These terms don't limit liability for:
252272
253These terms only limit our responsibilities as allowed by applicable law. These terms don't limit liability for gross negligence or willful misconduct.
273- fraud or fraudulent misrepresentation
274- death or personal injury caused by negligence
275- gross negligence
276- willful misconduct
254277
255To the extent allowed by applicable law:
278In addition, these terms don't limit your rights under product liability law.
256279
257- Google is liable only for its breaches of these terms or applicable [service-specific additional terms](https://policies.google.com/terms/service-specific)
258- Google isn't liable for:
259 - loss of profits, revenues, business opportunities, goodwill, or anticipated savings
260 - indirect or consequential losses
261 - punitive damages
262- Google's total liability arising out of or relating to these terms is limited to the greater of (1) $200 or (2) the fees paid to use the relevant services in the 12 months before the dispute
280For property damage or financial loss caused by Google, its representatives, or its agents due to slight negligence, Google is only liable for breaches of essential contractual obligations that result in typical damage foreseeable at the conclusion of the contract. An essential contractual obligation is an obligation that must be complied with as a prerequisite for the performance of the contract and that the parties may trust will be fulfilled. This does not change the burden of proof to your detriment.
± CHANGEDFlat liability cap removed

The previous cap limiting Google's total liability to $200 (or 12 months of fees) is gone. It's replaced by EU-style liability rules that keep Google fully liable for fraud, death or injury from negligence, gross negligence, and willful misconduct.

263281
264282### For business users and organizations only
265283

296314## Settling disputes, governing law, and courts
297315
298316For information about how to contact Google, please visit our [contact page](https://www.google.com/contact).
299317
300California law will govern these terms and all disputes arising out of or relating to these terms, [service-specific additional terms](https://policies.google.com/terms/service-specific), or any related [services](https://policies.google.com/terms), regardless of any conflict of laws rules. These disputes will be resolved exclusively in the federal or state courts of Santa Clara County, California, USA, and you and Google consent to personal jurisdiction in those courts.
318If you're a resident of, or an [organization](https://policies.google.com/terms) based in, the European Economic Area (EEA) or Switzerland, these terms and your relationship with Google under these terms and [service-specific additional terms](https://policies.google.com/terms/service-specific), are governed by the laws of your country of residence, and you can file legal disputes in your local courts. If you're an EEA-based [consumer](https://policies.google.com/terms), please [contact us](https://google.com/contact) to resolve issues directly. Google is not willing or required to participate in dispute resolution proceedings before a consumer arbitration board.
± CHANGEDDisputes move from California courts to your home country

Instead of requiring disputes to be resolved in Santa Clara County, California, EEA/Swiss users can now sue under their own country's law and in their own local courts.

301319
302320## About these terms
303321
304322By law, you have certain rights that can't be limited by a contract like these terms of service. These terms are in no way intended to restrict those rights.
305323
306These terms describe the relationship between you and Google. They don't create any legal rights for other people or [organizations](https://policies.google.com/terms), even if others benefit from that relationship under these terms.
307
308324We want to make these terms easy to understand, so we've used examples from our [services](https://policies.google.com/terms). But not all services mentioned may be available in your country.
309325
310If these terms conflict with the [service-specific additional terms](https://policies.google.com/terms/service-specific), the additional terms will govern for that service.
326We may update these terms and [service-specific additional terms](https://policies.google.com/terms/service-specific) (1) to reflect changes in our services or how we do business - for example, when we add new services, features, technologies, pricing, or benefits (or remove old ones), (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm.
311327
312If it turns out that a particular term is not valid or enforceable, this will not affect any other terms.
− REMOVEDBoilerplate clauses removed

The severability clause (invalid terms don't void the rest) and the statement that these terms create no rights for third parties were removed from the general 'About these terms' section.

328If we change these terms or [service-specific additional terms](https://policies.google.com/terms/service-specific), we'll provide you with at least 15 days' advance notice before the changes take effect. When we notify you of changes, we'll provide you with the new version of the terms and point out the material changes. If you don't object before the changes take effect, you'll be deemed to have accepted the changed terms. Our notice will explain this objection process. You can refuse to accept the changes, in which case the changes won't apply to you, but we reserve the right to end our relationship with you if all other termination requirements are met. You can also end your relationship with us at any time by [closing your Google Account](https://support.google.com/accounts/answer/32046).
313329
314If you don't follow these terms or the [service-specific additional terms](https://policies.google.com/terms/service-specific), and we don't take action right away, that doesn't mean we're giving up any rights that we may have, such as taking action in the future.
330## EEA instructions on withdrawal
315331
316We may update these terms and [service-specific additional terms](https://policies.google.com/terms/service-specific) (1) to reflect changes in our services or how we do business - for example, when we add new services, features, technologies, pricing, or benefits (or remove old ones), (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm.
332If you're an EEA-based [consumer](https://policies.google.com/terms), then EEA consumer law gives you the right to withdraw from this contract as described in the _EU's Model Instructions on Withdrawal_, provided below.
317333
318If we materially change these terms or [service-specific additional terms](https://policies.google.com/terms/service-specific), we'll provide you with reasonable advance notice and the opportunity to review the changes, except (1) when we launch a new service or feature, or (2) in urgent situations, such as preventing ongoing abuse or responding to legal requirements. If you don't agree to the new terms, you should remove [your content](https://policies.google.com/terms) and stop using the services. You can also end your relationship with us at any time by [closing your Google Account](https://support.google.com/accounts/answer/32046). If you close your Google Account and then access or use our services without an account, that access and use will be subject to the most current version of these terms.
334### Right of withdrawal
319335
336You have the right to withdraw from this contract within 14 days without giving any reason.
+ ADDEDNew 14-day right to withdraw from the agreement

EEA consumers now get a 14-day 'cooling-off' period to cancel the terms agreement without giving a reason, with a model withdrawal form and country-specific phone numbers provided.

337
338The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
339
340To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can contact us by email at [account-withdrawal@google.com](mailto:account-withdrawal@google.com); by phone [+353 1 533 9837](tel:+35315339837) (see below for [country-specific telephone numbers](https://policies.google.com/terms)); or by writing to us at Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at [g.co/EEAWithdrawalForm](https://g.co/EEAWithdrawalForm). If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (for example, by e-mail), including its content and the date and time of its submission, without undue delay.
341
342To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
343
344### Effects of withdrawal
345
346If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
