Report Abuse / DMCA Takedown
This is the first time we've captured Erome's Report Abuse / DMCA page, so the whole document shows up as new — these terms were probably already in place rather than just added. The page explains how to report copyright infringement, warns that false claims can get you sued, says repeat infringers can lose their account and every file they've uploaded, and points copyright owners to a third-party scanning service called DigiRegs. Notably, the email addresses for both the takedown notice and the copyright agent are blank on the page.
Repeat copyright complaints can wipe out everything you uploaded
If Erome judges you a repeat infringer, it can shut your account and permanently delete all of your uploads, including files nobody complained about. The page does not describe any appeal, counter-notice process, or way to get your files back, and 'permanently removed' means there is no recovery. Some form of repeat-infringer policy is standard for sites relying on DMCA protection, but the reach here is broad and the recourse is unstated.
“Any user found to be repeatedly infringing copyright may have their account terminated and all content they have uploaded permanently removed.”
What you can do — Keep your own backup of anything you upload, and only post material you own or clearly have permission to use.
You take on the legal risk if your takedown claim is wrong
Erome disclaims responsibility for false claims and says you may be on the hook for 'all legal actions' if your complaint turns out to be false. On top of that, the notice itself has to be sworn under penalty of perjury. So the person reporting carries the legal exposure, not the site.
“We are not liable for any false claims and you agree that if you have claimed a false claim of copyright infringement with us, that you may be held responsible for all legal actions.”
What you can do — Before filing, make sure you actually own the rights and that the use isn't fair use — get legal advice if you're unsure.
No email address is actually listed for takedown requests
The page tells you to 'send us an email at' but the address is missing, and the Copyright Agent block ends with a bare 'Email:' line. That leaves fax or postal mail as the only reliable ways to reach the agent, which slows down getting content taken down.
“Please do not send other inquires or information to our Designated Agent.”
What you can do — Send your notice by fax to +1 (800) 371-0235 or by mail to DMCA Now LLC, 100 S. Dixie Hwy., 3rd Floor, West Palm Beach, FL 33401, and keep proof you sent it.
Filing a complaint means handing over your real name and address
A valid notice requires your full legal name, mailing address, phone number, email, and signature. This is what the DMCA asks for, but it means your personal contact details are attached to the complaint and could be passed along to the person who uploaded the content.
“Provide your affiliation with the copyrighted work (if applicable), mailing address, telephone number and email address.”
What you can do — If you'd rather not expose your home address, have a lawyer or an agent file the notice on your behalf.
