How reviews are made

This is the first snapshot of DreamHost's General Terms of Service in our records — the previous version was empty, so the entire document shows up as "new." Nothing here is necessarily a fresh change by DreamHost; this is a baseline of the terms as they stand (last updated June 22, 2026). The terms are hosting-industry standard in structure but lean heavily in DreamHost's favor on money and risk: services auto-renew indefinitely at the regular (non-promotional) price, most products are non-refundable, DreamHost can suspend or shut down an account at its own discretion without a refund, its total liability is capped at what you paid in the last six months, and it can change the terms at any time with the burden on you to check the page. One standout is the feedback clause: any review, testimonial, or suggestion you give becomes DreamHost's on a perpetual, irrevocable, and exclusive basis. On the positive side, there is no forced arbitration and no class-action waiver, there is a real 30-day money-back guarantee on standard web hosting, and there is a clear cancellation link.

CONTENT LICENSE

Anything you tell DreamHost as a suggestion, review, or testimonial is licensed to the company permanently, cannot be taken back, and is granted "exclusive" — a word that normally means even you lose the right to use those words elsewhere. DreamHost can edit it and use it in marketing without paying you, crediting you, or telling you.

“You hereby grant to DreamHost a perpetual, worldwide, exclusive, irrevocable, and royalty-free license, and right to use, copy, modify, or otherwise utilize your suggestions, feedback, reviews, or testimonials for any purpose, including but not limited to marketing purposes, without any notice, compensation or other obligation to You.”

What you can do — Assume anything you write to DreamHost about the service can be reused in its ads. If you want to keep control of a review or testimonial, publish it on your own site or a review platform instead of sending it to DreamHost.

Automatic renewal at full price, with no refund for unused timeSERIOUS
BILLING & RENEWAL

Your plan renews by itself for the same length at the regular non-promotional rate, which can be much higher than the intro price you signed up at. Trials turn into paid plans automatically. If you cancel late, billing stops but you get nothing back for time you already paid for.

“At the end of the contract term, the contract will automatically renew at the then-current, non-promotional rate for the original contract length indefinitely until canceled. At the end of any trial period, the applicable Service will convert to the corresponding paid Service and be charged at the applicable rate, unless canceled prior to the trial end date.”

What you can do — Put a calendar reminder a week before each renewal date and before any trial ends, then cancel in the Manage Account panel at panel.dreamhost.com if you don't want to be charged. Renewals hit at midnight PST.

DreamHost can change the terms and add fees without telling youSERIOUS
UNILATERAL CHANGES

The company can rewrite these terms whenever it wants — including adding fees or discontinuing products — and it only "may" notify you. The written rule is that you have to keep checking the page yourself, and simply continuing to use your hosting counts as agreeing.

“In some instances, we may provide you with additional notice of updates including but not limited to adding a statement to the website, via the newsletter, or sending you an email notification. However, it is your responsibility to periodically check for the current version of our Terms by visiting this page (and other pages referenced in the Terms).”

What you can do — Check dreamhost.com/legal for the "Last Updated" date every few months, especially before a renewal, so a price or policy change doesn't take you by surprise.

Account can be shut off on suspicion alone, with no money backSERIOUS
TERMINATION

DreamHost can suspend or permanently disable your hosting whenever it decides, in its sole judgment, that there's a "reasonable suspicion" of a terms violation — and it doesn't have to refund you. The same no-refund shutdown applies if you don't cooperate with an investigation, don't answer account questions within 15 days, or trigger a sanctions block. Losing hosting on short notice can take your website and email offline.

“DreamHost reserves the right to disable or suspend without refund any account or service at any time should it feel, in its sole discretion, that there is a reasonable suspicion that it is being used in violation of any agreed upon terms.”

What you can do — Keep your own off-site backups of your website, databases, and email, and keep your contact details current so you can respond to DreamHost inquiries within 15 days.

Almost no warranties, and payouts capped at six months of feesSERIOUS
LIABILITY LIMITS

DreamHost disclaims warranties, says it isn't responsible for lost data, outages, or unauthorized access to its systems, and caps everything it could ever owe you at the total you paid in the six months before your claim. If a failure on their end destroys a business website, your recovery is limited to a few months of hosting fees.

“Customer's exclusive remedies and DreamHost's total liability for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, arising out of or in connection with these Terms or from the use or inability to use the Services, shall not exceed the aggregate amount which Customer paid to DreamHost during the six (6) months immediately preceding the claim.”

What you can do — Don't rely on DreamHost as your only copy of anything important — maintain independent backups, and consider business insurance if your site is revenue-critical.

You have to pay DreamHost's legal bills in certain disputesSERIOUS
LIABILITY LIMITS

If someone brings a claim over products you sell, material you upload, or copyright on your site, you must defend DreamHost and cover its losses and attorney fees. A separate promise makes you cover any export-control or sanctions fines caused by your breach, and that one survives even after you close your account.

“Customer agrees that it shall defend, indemnify, save and hold DreamHost harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys' fees, ("Liabilities") asserted against DreamHost”

What you can do — Make sure you actually own or have licensed every image, font, and piece of content you upload, since infringement claims land on you financially.

Failed card? DreamHost can charge other payment methodsMATERIAL
BILLING & RENEWAL

If your saved card expires or is declined, you've agreed DreamHost may charge other payment methods connected to your bank account, including replacement card numbers your issuer sends out automatically. Cancelling or replacing a card is not a reliable way to stop charges.

“If the customer's payment card is determined to be expired, invalid, or otherwise not able to be charged, the customer agrees that DreamHost may use other payment methods linked to the customer's bank account (such as new credit card credentials from your card issuer).”

What you can do — Cancel the service in the panel rather than relying on a card expiring, and remove old payment methods from your account when you leave.

New tiered fees for outdated software, with only 14 days' noticeMATERIAL
BILLING & RENEWAL

If DreamHost decides your software or configuration is end-of-life, it can charge extra maintenance fees that scale with how many sites you run. Notice is only 14 days before it starts, and fees already charged are never refunded — though you can cancel the affected service before the fee kicks in.

“DreamHost will provide such notice at least fourteen (14) days before the effective date, and may provide additional notices as a courtesy. If Customer does not agree to the Unsupported Software Maintenance Fees, Customer may cancel the affected Services before the effective date without incurring additional change fees.”

What you can do — Watch for fee-notice emails and keep your PHP, CMS, and server software on supported versions; if you get a notice, cancel or upgrade before the effective date to avoid the charge.

$50 penalty and account shutdown if you dispute a charge with your bankMATERIAL
BILLING & RENEWAL

Filing a chargeback — a normal consumer protection when you're billed wrongly — can get your services permanently disabled, and each rejected charge adds a $50 fee you must pay before anything is restored. This pushes you to settle billing problems only through DreamHost.

“Disputed charges ("chargebacks") associated with any DreamHost account, at DreamHost's discretion, may result in immediate and potentially permanent disablement of Services or the full account. Each rejected charge will incur a $50 fee on the account which must be paid before any Services may be reactivated.”

What you can do — Contact DreamHost support in writing first about any wrong charge and keep records; use a bank chargeback only as a last resort, after backing up your site.

Wide list of things that are never refundableMATERIAL
BILLING & RENEWAL

Domain registrations, SSL certificates, trials, Remixer fees and credits, third-party add-ons, and dedicated server payments are all non-refundable, and payment methods other than credit card and PayPal get no money-back guarantee at all. Prepaying for a year of a dedicated server means the money is gone even if you leave in month two.

“Domain registrations (including the value of any used domain registration credits included with the plan) are not refundable under any circumstances.”

What you can do — Pay by credit card or PayPal and start with a short term on anything you're unsure about, since long prepayments on excluded products can't be refunded.

Your billing currency is locked in permanentlyMATERIAL
OTHER

You choose a currency once at signup and can never change it, even if you move countries or the exchange rate moves against you. Prices in each currency may already build in conversion and regional markups, and DreamHost takes no responsibility for exchange-rate losses on refunds.

“Once you select a preferred currency, this choice is final and cannot be changed.”

What you can do — Compare the actual price in each available currency before you finish signup — you're stuck with the choice for the life of the account.

All disputes go to California law, wherever you liveMATERIAL
JURISDICTION

California law governs every dispute regardless of where you live or which currency you paid in. For customers outside California — especially outside the U.S. — that can mean losing the protections of local consumer law and facing a costly, distant legal process. Currency-conversion complaints are ruled out as a basis for a claim entirely.

“All transactions, regardless of currency, are governed by the laws of the State of California. In case of disputes, currency exchange rates will not be grounds for dispute resolution claims.”
You agree to automated calls and prerecorded messagesMINOR
USER OBLIGATIONS

By signing up you consent to DreamHost using robodialers and prerecorded voice messages on the landline or mobile number on your account. It's limited to non-promotional matters like billing and renewal reminders, but it's still consent you're giving away at signup.

“Customer agrees that DreamHost may use an automated dialing system and/or prerecorded voice messages to call the account primary contact landline or wireless phone number on file for any non-promotional account, informational, or Service-related purpose”
Account information can be passed to third partiesMINOR
DATA SHARING

You grant DreamHost permission to share your account details with outside companies for fraud prevention and security. The purpose is narrow and it's tied to the Privacy Policy, but it is still a standing consent to disclose your information without asking you first.

“You hereby grant us the right to disclose to third parties, in accordance with our Privacy Policy and Data Processing Addendum, such Account Information for the purposes of fraud prevention and ensuring the security and integrity of DreamHost systems.”

The 100% uptime guarantee pays out very littleMINOR
OTHER

DreamHost advertises 100% uptime, but compensation is capped at 10% of your next renewal fee, comes as account credit rather than cash, and the outage clock only starts once you open a support ticket — so downtime you sleep through may not count.

What you can do — Open a support ticket as soon as you notice an outage, and claim DreamObjects credits within 14 days, or you lose the compensation.

    When your term ends, DreamHost renews it automatically for the same length at the then-current, non-promotional rate — so a cheap intro deal renews at full price. Free trials roll into paid service unless you cancel first. You must cancel before the renewal date (midnight PST) to stop it.

    The "30-Day Money-Back Guarantee" offer is only applicable to credit card and PayPal payments for DreamHost Website Hosting Services, excluding Email Service, Dedicated Server, Self-Managed VPS, Remixer, and DreamCompute products.

  4. + ADDEDNo refunds for unused time after you cancel

    Once you're past the 30-day window, canceling stops future billing but you don't get money back for the part of the term you already paid for and won't use. Dedicated server payments are explicitly non-refundable.

    You pick a billing currency when you open the account and can never change it. Prices in each currency may already include conversion costs and regional pricing, and exchange-rate differences on refunds are your problem.

    If you run outdated or end-of-life software, DreamHost can charge extra tiered maintenance fees based on how many sites need it. You get at least 14 days' notice and can cancel the affected service before the fee starts, but no refunds for fees already charged.

    DreamHost may require Customer to enroll in an additional maintenance plan or pay additional maintenance fees ("Unsupported Software Maintenance Fees") to continue providing the Services.

  7. + ADDED$50 fee and possible account shutdown for chargebacks

    If you dispute a charge with your bank, DreamHost can permanently disable your services and charges $50 per rejected charge, which you must pay before anything is turned back on.

    Each rejected charge will incur a $50 fee on the account which must be paid before any Services may be reactivated.

  8. + ADDEDAccounts can be suspended on suspicion alone, with no refund

    DreamHost can disable or suspend any account at its sole discretion if it merely suspects a terms violation, and owes you nothing back. Either side can also end the contract with 14 days' notice, and DreamHost may charge a reinstatement fee.

    DreamHost reserves the right to disable or suspend without refund any account or service at any time should it feel, in its sole discretion, that there is a reasonable suspicion that it is being used in violation of any agreed upon terms.

  9. + ADDEDIgnoring DreamHost's account-info questions can cost you the account

    If you don't keep your account details current, or don't reply within 15 days when DreamHost asks about their accuracy, your account can be suspended or disabled with no refund.

    The Terms and the resolution of any disputes shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

  17. + ADDEDNo forced arbitration and no class-action waiver

    Unlike many hosting providers, these terms do not force you into private arbitration and do not stop you from joining a class action. Disputes go to court under California law.

  18. + ADDEDUptime promises: 100% guarantee with capped credits, plus a 99.9% DreamObjects SLA

    DreamHost advertises 100% uptime and gives credit of one day's hosting per hour of outage, but capped at 10% of your next renewal, and the clock only starts when you file a support ticket. DreamObjects has a separate 99.9% credit scheme you must claim within 14 days.

    You promise you're not in a sanctioned country or on a U.S. restricted-party list. If a payment is blocked for sanctions reasons, DreamHost can suspend or disable your account with no warning and no refund.

  20. + ADDEDYou're bound by several other policies and partner terms

    The Acceptable Use Policy, Anti-Spam Policy, Unlimited Policy, Privacy Policy, Data Processing Addendum, Professional Services Terms, and Domain Registration Terms all become part of your agreement. Using certain builders also binds you to BoldGrid, Google Workspace, Let's Encrypt, or OpenAI terms.

  21. + ADDEDYou must be 18 and technically capable

    You certify you're at least 18 (or a parent/guardian is the real customer), that you have the technical knowledge to run your site, and that support beyond DreamHost's defined service isn't its responsibility.

    The Customer certifies that they are at least 18 years of age, or that their parent or legal guardian will act as the "customer" in terms of this contract.

9DreamHost offers a variety of services to customers that range from hosting and website services (including shared, VPS, and dedicated hosting, WordPress hosting, Remixer, email, cloud services, and domain registration services, among others). These services are collectively referred to as "Services."

11By using DreamHost's Services, Customer agrees to these Terms of Service and any other policies or terms referenced or published by us (collectively, the "Terms"). If Customer does not accept these Terms, Customer must not register an account or purchase, access, or use DreamHost's Services in any way.

13These Terms form a binding legal agreement between DreamHost and any person or organization who purchases, accesses, or uses DreamHost's Services ("Customer" or "You"). Customer represents, warrants, and agrees that (a) Customer has the full power and authority to enter into and perform under these Terms, or (b) if Customer is using these Services on behalf of an organization, entity, or group, that Customer is authorized to accept these Terms.

15**Account Information**

You agree to provide certain current, complete, and accurate information about you as required by the account creation process, and to maintain or update this information as needed to keep it current, complete, and accurate. All such information shall be referred to as account information ("Account Information").
182. You hereby grant us the right to disclose to third parties, in accordance with our Privacy Policy and Data Processing Addendum, such Account Information for the purposes of fraud prevention and ensuring the security and integrity of DreamHost systems.
193. Providing any false Account Information is considered a violation of DreamHost's terms. DreamHost may deny the creation of an account should it feel in its sole discretion that any incomplete, or inaccurate Account Information is provided during account creation. Any payments made incident to such a denied account will be refunded or canceled.
204. Customer agrees that DreamHost may use an automated dialing system and/or prerecorded voice messages to call the account primary contact landline or wireless phone number on file for any non-promotional account, informational, or Service-related purpose such as, without limitation, billing and renewal reminders, subject to applicable law.
215. DreamHost may suspend or disable any existing account without refund should Customer willfully fail to promptly update Account Information upon its change, or fail to respond for over fifteen (15) calendar days to inquiries by DreamHost concerning the accuracy of any Account Information.

23**Financial Arrangements**

25When creating an account, you may select your preferred currency. **Once you select a preferred currency, this choice is final and cannot be changed.** All future transactions will be processed in the selected currency. **Prices are standardized and may account for operational costs, including currency conversion fees and regional pricing policies.** By proceeding with a currency selection, you acknowledge and accept this policy.

27Customer agrees to a thirty (30) day contract minimum beginning upon commencement of service. Exact contract duration is decided upon at signup.

29Customer agrees that all charges and fees associated with an account are their sole responsibility. Failure to make payment within sixty (60) days of the due date may result in restriction of access to, or suspension of Services.

31If the customer wishes to cancel DreamHost Website Hosting Services, excluding Email Service, Dedicated Server, Self-Managed VPS, Remixer, and DreamCompute products, within thirty (30) days of initial signup, they shall be able to do so for any reason (aside from disablement for Terms of Service, or incorporated policy violations) and have their money promptly refunded.

33Services provided by third parties and DreamHost partners are not part of the 30-day refund policy, and no early-ending credit applies. Billing will stop at the end of the term during which the service is canceled.

35**AUTOMATIC RENEWAL**: **At the end of the contract term, the contract will automatically renew at the then-current, non-promotional rate for the original contract length indefinitely until canceled. At the end of any trial period, the applicable Service will convert to the corresponding paid Service and be charged at the applicable rate, unless canceled prior to the trial end date.**

37**DreamHost will automatically renew the applicable service when it comes up for renewal and will take payment from the payment method associated with your account. If you do not wish for any service to automatically renew, you may elect to cancel that service, in which case, your Services will terminate upon expiration of the then-current term, unless you manually renew your Services before that date. Any Services must be canceled prior to their renewal date(s) in order to avoid automatic renewals. Renewal dates take effect at midnight, PST.**

39**If the customer's payment card is determined to be expired, invalid, or otherwise not able to be charged, the customer agrees that DreamHost may use other payment methods linked to the customer's bank account (such as new credit card credentials from your card issuer). If a DreamHost Service is terminated after the 30-day Money-Back Guarantee period, as applicable to Website Hosting Services, excluding Email Service, Dedicated Server, Self-Managed VPS, Remixer, and DreamCompute products, the Service will be canceled before the next payment is due, and no more billing will occur, nor will any payment be refunded, even for unused portions. If any non-refundable charges have already been incurred, they must be paid before the account may be canceled.**

43The "30-Day Money-Back Guarantee" offer is only applicable to credit card and PayPal payments for DreamHost Website Hosting Services, excluding Email Service, Dedicated Server, Self-Managed VPS, Remixer, and DreamCompute products. Other forms of payment are non-refundable. Refunds are not available for the value of any trial periods of any services. Domain registrations (including the value of any used domain registration credits included with the plan) are not refundable under any circumstances. SSL certificates are non-refundable. Remixer subscription fees, and Remixer Credits are non-refundable. The value of any AdWords credit or other third-party add-ons is non-refundable.

45Violations of DreamHost's Terms may, at DreamHost's discretion, result in immediate and permanent disablement without refund.

49Disputed charges ("chargebacks") associated with any DreamHost account, at DreamHost's discretion, may result in immediate and potentially permanent disablement of Services or the full account. Each rejected charge will incur a $50 fee on the account which must be paid before any Services may be reactivated.

51DreamHost reserves the right to modify service plans, fees, and applicable charges. If Customer's Services include software, configurations, or features that are end-of-life, outdated, or unsupported ("Unsupported Software"), DreamHost may require Customer to enroll in an additional maintenance plan or pay additional maintenance fees ("Unsupported Software Maintenance Fees") to continue providing the Services. Unsupported Software Maintenance Fees may be tiered based on the number of Customer websites, applications, instances, or environments (each, a "Site") that require Unsupported Software maintenance during a billing period. DreamHost will determine the applicable tier based on the count of Sites daily, and will apply the applicable tier to the next billing period. If Customer's applicable tier would change due to an increase or decrease in the number of Sites requiring Unsupported Software maintenance, DreamHost will notify Customer of the new tier and the effective date. Increases will take effect on the next billing date following the notice period above; decreases will take effect on the next billing date after DreamHost's verification.

53Before charging Unsupported Software Maintenance Fees, DreamHost will provide Customer advance notice describing: (i) the reason for the fee, (ii) the applicable tier and fee amount, (iii) the effective date, and (iv) methods to avoid or prevent the fee. DreamHost will provide such notice at least fourteen (14) days before the effective date, and may provide additional notices as a courtesy. If Customer does not agree to the Unsupported Software Maintenance Fees, Customer may cancel the affected Services before the effective date without incurring additional change fees. No refunds will be payable for fees previously assessed or for partial billing periods.

55DreamHost will use commercially reasonable efforts to make DreamObjects available 99.9% of the time during each monthly billing cycle. If DreamHost is unable to meet this service level, you will be eligible to receive a credit to apply to future DreamObjects billing cycles based upon the Unavailability for that month.

571. For the purposes of this agreement, Unavailability means that either (a) the DreamObjects service is unresponsive, or (b) DreamObjects returns a server error response to valid user requests for more than 60 seconds of consecutive requests.
582. Unavailability that is a result of scheduled maintenance is excluded from these conditions and will not be considered for service credit calculations. Scheduled maintenance is defined as maintenance that is announced at least 5 days in advance, and does not exceed one hour in any month.
593. Service credits will be calculated as a percentage of the bill for the billing cycle that the Unavailability occurred. The percentage for the credit will be calculated by dividing the number of minutes of Unavailability by the total number of minutes in that billing cycle.
604. Service credits must be claimed within 14 days of the Unavailability occurring by submitting a support ticket. Include as much detail as required to document the Unavailability.

If a refund must be converted to USD, it will be based on the exchange rate at the time of refund processing, which may differ from the rate at the time of purchase. DreamHost is not responsible for any exchange rate differences.

Use of any information obtained by way of DreamHost is at the Customer's own risk, and DreamHost specifically denies any responsibility for the accuracy or quality of information obtained through its Services. Any mention of connection speeds associated with DreamHost's Services represents the maximum achievable speed. DreamHost does not guarantee that the customer will achieve the maximum connection speed at all times, as this depends on a variety of factors (including your own internet connection!). DreamHost expressly limits its damages to the Customer for any non-accessibility time or other down time to the pro-rata monthly charge during the system unavailability.

93DreamHost specifically denies any responsibilities for any damages arising as a consequence of such unavailability. In the event that this material is not "Server-ready", DreamHost may, at its option and at any time, reject this material, including but not limited to after it has been put on DreamHost's servers. DreamHost agrees to notify Customer immediately of its refusal of the material and afford Customer the opportunity to amend or modify the material to satisfy the needs and/or requirements of DreamHost. If the Customer fails to modify the material, as directed by DreamHost, within a reasonable period of time, which shall be determined between the parties themselves, the contract shall be deemed to be terminated.

95All domain names registered through DreamHost or its previous domain registration site, domainitron.com, that are 'parked' or are otherwise not immediately associated with a DreamHost hosting plan will be automatically pointed to a "Coming Soon" web page which informs visitors that the registrant has recently registered their domain name via Dreamhost.com. The Coming Soon web page may be modified at any time by DreamHost without prior notice to you and may include such things as, without limitation, links to additional products and Services offered by DreamHost.

1152. Customer is entitled to compensation if Customer's web site, databases, email, FTP, SSH or webmail become unusable as a result of failure(s) in DreamHost systems for reasons other than previously announced scheduled maintenance, coding or configuration errors on the part of the Customer.
1163. Customer will receive DreamHost credit equal to the Customer's current hosting cost for 1 (one) day of service for each 1 (one) hour (or fraction thereof) of service interruption, up to a maximum of 10% of Customer's next pre-paid hosting renewal fee.
1174. DreamHost's assessment of downtime begins when Customer opens a support ticket to report the problem.

119**DreamHost Dedicated Server and DreamCompute Stipulations**

For example, if Customer submits payment for twelve (12) months of service, service will be provided for twelve (12) months and will not be refunded if Customer chooses to discontinue service with DreamHost mid-way through the term. DreamCompute services will be billed on a monthly basis; existing DreamCompute customers may remain on a pre-paid billing plan, but new customer accounts will be subject to a usage-billing plan. Termination or upgrades of DreamCompute services will result in the following refund and billing procedures:

1271. Pre-Paid Billing DreamCompute Plan: Any termination or upgrade will result in a refund of the prorated value of the plan for the last billing period.

132You acknowledge that the privileges associated with creating and utilizing an Admin User grant significant control over a Dedicated Server, and that improper or incorrect use of these privileges may substantially damage a server's configuration. You further acknowledge that if such damage occurs due to your actions, DreamHost Technical Support may be unable to rectify the issue. In such cases, the server's configuration may need to be reset, or the operating system may need to be re-installed.

134Any hands-on labor necessitated by the customer (including, but not limited to, re-installing the operating system on the server) shall be performed by DreamHost and shall incur an additional one-time labor fee of $100 for each incident.

DreamHost is not required to upgrade Customers' hardware or bandwidth allocation as a result of a pricing or service package change. There will be an additional charge of $200 associated with any such hardware upgrade requested by Customer. Customer will not be required to upgrade hardware as a result of a pricing change.

138For managed servers, DreamHost is responsible for the security of the network, the kernel, and the base operating system (defined as the standard set of debian packages that come installed with the server). DreamHost may take any steps it deems necessary at any time to protect the security of your server (this generally includes applying security patches as well as upgrading the entire operating system).

140For unmanaged servers not using a "DreamCatcher" monitoring option, Customer is responsible for keeping the security of their system up to date. This includes but is not limited to the following requirements:

1421. The kernel will be patched within 7 days of any announced security hole relating to the kernel
1432. Any security patches for all installed software must be applied within 7 days of their general announcement to the security community at large.

145DreamHost is not responsible for notifying unmanaged servers of the need to apply patches. Failure to comply with these requirements is grounds for termination of contract without refund. DreamHost reserves the right to take any action upon unmanaged dedicated servers it deems necessary at any time to protect the security and integrity of DreamHost's network.

1491. The Customer certifies that they are at least 18 years of age, or that their parent or legal guardian will act as the "customer" in terms of this contract.

Notwithstanding the above, DreamHost may terminate service under this contract at any time, without penalty, if the Customer fails to comply with the terms of this contract, including non-payment. DreamHost reserves the right to charge a reinstatement fee.

1571. Customer expressly agrees that use of DreamHost's Services is at Customer's sole risk. Neither DreamHost, its employees, affiliates, agents, third party information providers, merchants licensers or the like, warrant that DreamHost's Services will not be interrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the Services or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through DreamHost Services, unless otherwise expressly stated in this contract.

Under no circumstances, including negligence, shall DreamHost, its offices, agents or anyone else involved in creating, producing or distributing DreamHost's Server service be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use DreamHost's Services; or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to DreamHost's records, programs or services. Customer hereby acknowledges that this paragraph shall apply to all content utilizing DreamHost's Services.
1593. Notwithstanding the above, Customer's exclusive remedies and DreamHost's total liability for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, arising out of or in connection with these Terms or from the use or inability to use the Services, shall not exceed the aggregate amount which Customer paid to DreamHost during the six (6) months immediately preceding the claim.

Customer agrees to defend, indemnify and hold harmless DreamHost against Liabilities arising out of

178Customer agrees to comply with all applicable export control laws and regulations, including, without limitation, the U.S. Export Administration Regulations (EAR), the International Traffic in Arms Regulations (ITAR), and economic sanctions regulations administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC). Customer represents and warrants that it is not (i) located in, or a resident or national of, any country subject to U.S. embargo or sanctions, or (ii) identified on any U.S. government restricted party list, including, without limitation, the Specially Designated Nationals (SDN) List or any other sanctions lists administered by OFAC.

180Customer covenants that it shall not - directly or indirectly - sell, export, re-export, transfer, divert, or otherwise dispose of any products, software, or technology (including products derived from or based on such technology) received from DreamHost under this Agreement to any destination, entity, or person prohibited by the laws or regulations of the United States, without obtaining prior authorization from the competent government authorities as required by those laws and regulations.

182In the event that any transaction is denied, blocked, or reversed due to sanctions compliance obligations, including but not limited to restrictions involving sanctioned jurisdictions, entities, or individuals, DreamHost may suspend or disable the associated account or access without prior notice or refund.

184Customer agrees to indemnify, to the fullest extent permitted by law, DreamHost from and against any fines or penalties that may arise as a result of Customer's breach of this provision. This Export Control clause shall survive termination or cancellation of this Agreement.
