CRITICAL
DATED 2025-07-29 · VERSION 20260811_rev01 · FIRST CAPTURED VERSION

What changed, in plain language

How reviews are made

This is the first complete capture of Daily Mail's website Terms — the earlier snapshot was empty, so everything appears as "added" even though the page itself says it was last updated on 29 July 2025. Nothing here is necessarily brand new; treat it as a baseline of what you agree to. The most important points: anything you post (comments, photos, video) is licensed to Daily Mail forever, they can never be forced to take it back, and they can pass it to sister brands like Metro and The i paper. You also give up your right to be credited. Daily Mail can change the terms whenever it likes and simply carrying on using the site counts as your agreement. They can delete your posts or close your account at their own discretion, and they take on very little legal responsibility for the site or its content.

Changes that may affect you

Permanent, irreversible licence over everything you post — including for sister brandsCRITICAL
CONTENT LICENSE

Anything you submit can be used, edited, translated and republished by Daily Mail forever, worldwide, for free. "Irrevocable" means you can never take that permission back, even if you delete your account. They can also hand the rights to other companies in their group such as This is Money, Metro and The i paper, and use your words in their adverts. Practically, once you hit post, you lose control of it for good.

“The licence is capable of sub-license by us to other entities and brands in our group of companies (including, without limitation, This is Money, Metro, The i paper)”

What you can do — Do not post anything in the comments you would ever want pulled back, credited to you, or kept out of an advert. Deleting your account will not undo the licence.

You give up your right to be named as the authorSERIOUS
CONTENT LICENSE

Waiving your "moral rights" means you cannot demand credit for what you wrote, and you cannot object if it is edited in a way that distorts your meaning or embarrasses you.

“To the extent permitted by law, you waive your moral rights (e.g. the right to be identified as author or to object to derogatory treatment) in Your Content.”
Terms can change with no notice and silence counts as agreementSERIOUS
UNILATERAL CHANGES

Daily Mail can rewrite these terms whenever they want. They will not tell you — the new version just goes up on the site, and if you keep visiting you are treated as having agreed. The burden is entirely on you to keep checking.

“From time to time, we may update our Terms. The revised Terms will be available on our Site. Please check back regularly to ensure you are aware of any changes we may make.”

What you can do — Check the "Updated" date at the top of the terms page occasionally if you have a registered account.

Your account can be closed at any time, for any reason, with no appealSERIOUS
TERMINATION

They can suspend or delete your registration purely because they choose to — a breach is only given as an example, not a requirement. There is no complaints or appeals route described, and you are barred from signing up again without their permission.

“We may suspend, terminate or prevent your registration at our sole discretion.”
Your posts stay published after you leave, but may also vanish without warningMATERIAL
DATA RETENTION

This cuts both ways against you. Asking them to remove your comments, or closing your account, does not oblige them to take your content down — your name, town and country can stay online. At the same time they promise nothing about keeping your content and may delete it permanently without keeping a copy.

“We make no guarantee that your content will be kept on the Site for any length of time, and we reserve the right to remove your content as we see fit.”

What you can do — Keep your own copies of anything you post that matters to you — the terms explicitly tell you to.

They accept almost no responsibility for the site or what is on itMATERIAL
LIABILITY LIMITS

No warranties are given about the site at all. They are not liable if you act on something you read there and lose out, not liable for your dealings with advertisers or other users, and not liable for third-party content or linked sites. Legally required protections — death or injury from their negligence, and fraud — still stand.

“We give no warranties of any kind in relation to the Site or its contents.”
You agree to cover their legal bills if you misuse embedded contentMATERIAL
LIABILITY LIMITS

If you put a Daily Mail embed on your own website or profile and break their embedding rules, you promise to pay their damages, costs, legal fees and litigation expenses. That is an open-ended financial commitment with no cap.

“You agree to reimburse Us in respect of all damages, costs and expenses, including reasonable legal fees and litigation expenses, arising out of or as a result of any breach of these Embedding Terms”

What you can do — Only embed Daily Mail content on a personal, non-commercial page, and never in a way that earns you advertising money.

Wide-ranging restrictions on what you can do with the siteMINOR
USER OBLIGATIONS

You cannot scrape or bulk-copy the site, cannot build a database from it, and cannot use its content to train AI or for text and data mining. You also cannot post links to other websites in comments, cannot share an account, and are held responsible for everything done under your login.

“to use any content, files or data from the Site to make or populate a database or publication of any kind whatsoever, to develop or train any software program (including any machine learning or artificial intelligence systems)”
UK-only focus and English lawMINOR
JURISDICTION

The terms are governed by English law and the site says it is intended for UK visitors only. For UK readers this is normal and fair — Scottish and Northern Irish users can even use their home courts. If you are outside the UK, you are responsible for your own local laws and would likely be dealing with English courts.

“These Terms are governed by English law, and you can bring legal proceedings in respect of these Terms in the English courts.”

Changelog

  1. + ADDEDFull terms captured for the first time

The previous snapshot of this page was empty, so the whole document shows up as new. The page states it was last updated on 29 July 2025, so these are most likely long-standing terms rather than fresh changes.

  2. + ADDEDForever licence over anything you post

When you submit a comment or other material, you keep your copyright but hand Daily Mail a free, permanent licence to use, edit, translate, adapt and republish it anywhere, in any format that exists now or is invented later. They can also pass that right on to other brands in their group.

you grant us a royalty-free, perpetual, irrevocable, non-exclusive worldwide licence to use, copy, edit, adapt, publish, translate, create derivative works from, make available, communicate and distribute Your Content

  3. + ADDEDYou give up the right to be credited as the author

You waive your "moral rights", meaning you cannot insist on being named as the author and cannot object if your words are edited in a way you dislike.

  4. + ADDEDYour posts can stay up even after you leave

    Continue to publish all or part of Your Content, including your name, town and country, even if you change your mind and want us to remove it and/or you are no longer registered with the Site;

  5. + ADDEDYour content can also be used in their advertising

They can put your comments into promotional material, for example a screenshot of your post in an advert.

    Use all or part of Your Content in promoting our products and services (e.g. we may use a screenshot including your comments in our advertising);

  6. + ADDEDTerms can change at any time, and using the site means you accept

There is no advance notice or email. The new terms just appear on the site, and continuing to browse counts as agreeing to them.

If you continue to use our Site after we make any changes, you will be deemed to have accepted any changes to our Terms

We give no warranties of any kind in relation to the Site or its contents.

  11. + ADDEDStrict ban on scraping, copying and AI training

You may not scrape the site, build a database from it, or use its content to train software or AI systems. Personal printing of the odd page is allowed.

to develop or train any software program (including any machine learning or artificial intelligence systems), or for the purpose of text/ data mining or analysis

  12. + ADDEDRules for registering and posting

You must be 16 or over, may only have one account, must keep your password private, and are responsible for everything done through your account. Posts must not be defamatory, obscene, harassing, or contain links to other websites.

You must be 16 years old or older to register and submit material (e.g. comments) to the Site.

  13. + ADDEDGood news: courts, not arbitration, and a local option

Disputes go to the courts under English law. If you live in Scotland or Northern Ireland you can sue in your own country's courts instead. There is no forced arbitration and no class-action waiver.

If you live in Scotland, you can bring legal proceedings in respect of the Terms in either the Scottish or the English courts.

  14. + ADDEDSite is aimed at UK users only

The terms say the site is meant for people accessing it from the UK. If you use it elsewhere, following your local laws is your problem.

Our Site is intended for use only by those who can access it from within the United Kingdom.
