How reviews are made

This is the first captured version of AZNude's DMCA Policy, so everything in it is new to our record. It explains how to report copyrighted material, how to fight back if your upload is taken down by mistake, and what AZNude can do to your account. The parts that can hurt you: AZNude can shut down your account at its sole discretion even without repeat infringement, filing a counter-notice hands your name, address and phone number to the person who complained, copies of notices may be published on the Lumen database and in transparency reports, and filing a counter-notice means agreeing to be sued in a U.S. federal court.

The policy lets AZNude cut off access or disable accounts entirely at its own discretion, and it explicitly says this applies even when there is no repeat infringement. There is no described warning, appeal, or refund path, and 'sole discretion' means you cannot demand a review of the decision.

To dispute a removal you must give your full name, home address and phone number, and AZNude forwards all of it to the person who filed the complaint. That person may be a stranger. This is required by copyright law, but it is a real privacy cost that you should know about before you file.

What you can do — Before filing a counter-notice, weigh whether you are comfortable with the complainer having your contact details, and consider using a lawyer or authorized agent to file on your behalf.

DATA SHARING

Copies of legal notices can be sent to Lumen, a public website, and republished in AZNude's own transparency reports. Lumen removes submitters' contact information, but the rest of what you wrote can become publicly searchable. The promise about transparency reports is vaguer — it only says 'similar information' will be published.

What you can do — Do not include private details in the body of a notice beyond what the law requires, since the text may end up public.

Disputing a removal means agreeing to be sued in a U.S. federal courtMATERIAL
JURISDICTION

You cannot file a counter-notice without agreeing that a U.S. federal court can decide the case and that you will accept legal papers from the complainer. If you live outside the United States, you agree to any district where AZNude's operator can be found, which could be far from you and expensive to reach.

USER OBLIGATIONS

Emails with attachments are thrown away and never processed, and AZNude says it will not respond to counter-notices that miss any required element. You may never learn your submission was ignored. Both notices and counter-notices also require statements made under penalty of perjury, and a knowingly false takedown claim can leave you paying the other side's legal fees.

What you can do — Put every required item in the body of the email with no attachments, keep a copy of what you sent, and follow up if you get no response.

    This policy is intended to implement the procedures set forth in 17 U.S.C. Section 512 and the Digital Millennium Copyright Act ("DMCA") for the reporting of alleged copyright infringement.

    There is a single designated agent email that is only for copyright claims. Anything else sent there gets no reply. Emails with attachments are not received or processed at all, so you must put everything in the body of the message.

    Please note that, due to security concerns, attachments cannot be accepted. Accordingly, any notification of infringement submitted electronically with an attachment will not be received or processed.

    A notice must include a signature, identification of the work and the infringing material, your contact details, a good-faith statement, and a statement made under penalty of perjury. Missing anything can delay processing.

    Failure to include all of the above information may result in a delay of the processing or the DMCA notification.

    If you knowingly claim something is infringing when it is not, you can be made to pay damages, including the other side's legal fees.

    If your content was removed by mistake, only you (the original uploader) or your authorized agent can file a counter-notice. AZNude forwards it to the complainer, and content may go back up after 10 but within 14 business days unless the complainer sues you.

23If you believe your copyrighted material has been used in a way that constitutes copyright infringement, you may file a complaint ("DMCA Notice") with us. The DMCA Notice must include the following elements:

25- An electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
26- Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notice, a representative list of such works at that site.
27- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material.
28- Information reasonably sufficient to permit the Company to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
29- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
30- A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

34## Counter-Notification Procedures

36If you have received a DMCA Notice and believe that material you posted on [\[email protected\]](https://aznude.com/cdn-cgi/l/email-protection) was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us ("Counter-Notice"). Counter-Notices must be submitted by the original uploader of the content, or an agent authorized to act on their behalf. Counter-Notices must include the following:

38- Your name, address, phone number, and physical or electronic signature;
39- Identification of the allegedly infringing content and its location before removal or access to it was disabled;
40- A statement under penalty of perjury that you believe in good faith that the content was removed by mistake or misidentification;
41- A statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which you are located (or if you are outside the U.S., for any judicial district in which the operator of AZNude may be found), and that you will accept service of process from the person who originally provided us with the DMCA Notice or an agent of such person.

43We will not respond to counter-notifications that do not meet the requirements above. When we receive your Counter-Notice, we will forward it to the original claimant and inform them that the removed material may be restored after ten (10) business days but no later than fourteen (14) business days from the date we received your Counter-Notice, unless the original claimant informs us that they have filed a court action to restrain you from engaging in infringing activity related to the material in question.
